These Terms of Service (“Terms”) govern purchases and use of the website and products offered by Golden Goose Smokers (“Golden Goose Smokers,” “we,” “us,” or “our”). By accessing our website, placing an order, or purchasing our products, you agree to these Terms.

1. Products and Custom Orders

Golden Goose Smokers manufactures and sells custom smokers, grills, BBQ equipment, accessories, and related products.

Because many of our products are handcrafted and/or made to order, product dimensions, appearance, finish, color, hardware, and other details may vary slightly from photographs, drawings, samples, or product descriptions.

For custom orders, the specifications approved by the customer at the time of order will govern the finished product.

Customers are responsible for reviewing and approving all custom specifications, including dimensions, finishes, colors, logos, accessories, mounting requirements, and other requested modifications, before fabrication begins.

2. Pricing

Prices displayed on our website are subject to change without notice. The price applicable to an order is the price shown at the time the order is placed, unless otherwise agreed to in writing.

Custom orders may require a written quotation. A quotation is valid for the period stated on the quotation. If no expiration date is specified, the quotation is valid for 30 days.

Unless otherwise stated, prices do not include applicable sales tax, shipping, delivery, installation, or other charges.

3. Payment

Payment is required according to the terms presented at checkout, on the applicable invoice, or in the written quotation.

For custom fabrication orders, we may require a deposit before materials are purchased or fabrication begins. The required deposit amount will be communicated to the customer before the order is accepted.

Applicable Sales Tax: Sales tax applicable to the customer's state and the transaction will be calculated and added to the total order cost where required by law. Sales tax is collected and remitted as required by applicable tax laws. Sales tax charged on an order is not refundable by Golden Goose Smokers except where a refund or adjustment is required by applicable law.

The remaining balance is due according to the payment terms provided with the order.

We reserve the right to delay fabrication, shipment, delivery, or release of a product until required payments have been received.

4. Custom Orders and Customer Approval

Custom products are manufactured specifically for the customer and may not be suitable for resale to another customer.

Once fabrication of a custom order has begun, the customer may not cancel, modify, or materially change the order without our written approval.

If we approve a cancellation or modification after work has begun, the customer may be responsible for costs already incurred, including materials purchased, labor performed, engineering or design work, fabrication work, finishing, shipping charges, and other non-recoverable expenses.

Any remaining refundable balance will be determined after deducting applicable costs already incurred.

5. Order Changes

Requests to change an order must be submitted as soon as possible and are subject to our approval.

Changes requested after fabrication has begun may result in additional charges and may extend the estimated completion date.

We are not responsible for delays or additional costs resulting from customer-requested changes.

6. Production and Delivery Times

Estimated production and delivery dates are estimates and are not guaranteed unless specifically agreed to in writing.

Production times may vary depending on product type, customization, material availability, workload, shipping conditions, and other circumstances.

We will make reasonable efforts to communicate significant delays.

A delay in production or delivery does not automatically entitle a customer to cancel an order or receive a refund unless otherwise required by applicable law or agreed to in writing.

7. Shipping and Delivery

Shipping and delivery charges are the responsibility of the customer unless otherwise stated.

Risk of loss may transfer to the customer upon delivery to the shipping carrier or upon delivery to the customer, as applicable under the shipping arrangement and applicable law.

Customers are responsible for providing accurate shipping and delivery information.

Additional charges resulting from an incorrect address, missed delivery, storage, redelivery, or customer-requested delivery changes may be charged to the customer.

Customers should inspect shipments promptly upon delivery. Damage should be documented with photographs and reported to Golden Goose Smokers as soon as reasonably possible.

8. Damaged, Defective, or Incorrect Products

If a product arrives damaged, defective, or materially different from the product ordered, contact us promptly at:

Please provide the order number and photographs or other documentation reasonably requested by us.

We will evaluate the issue and, where appropriate, provide a repair, replacement, refund, or other reasonable resolution.

10. Warranty

Unless a separate written warranty is provided for a particular product, products are covered only by any warranty specifically stated on the applicable product page, quotation, invoice, or other written agreement.

Warranty coverage does not generally include damage caused by misuse, improper installation, improper maintenance, unauthorized modifications, accidents, normal wear and tear, or use contrary to provided instructions.

Warranty claims may require photographs, proof of purchase, product information, or inspection of the product.

11. Safe Use of BBQ and Cooking Equipment

Smokers, grills, fireboxes, and other cooking equipment can become extremely hot and may involve fire, smoke, fuel, gas, grease, and other hazards.

Customers are responsible for using products safely and in accordance with applicable manufacturer instructions, fire codes, building codes, fuel requirements, and local laws.

Customers are responsible for ensuring that the location and installation of the equipment are appropriate for its intended use.

Unless specifically agreed in writing, Golden Goose Smokers is not responsible for installation, site preparation, permits, code compliance, or modifications to a customer's property.

12. Intellectual Property

All website content, photographs, product designs, logos, trademarks, text, graphics, and other materials owned by Golden Goose Smokers are protected by applicable intellectual property laws.

Customers may not reproduce, copy, modify, distribute, or commercially use our protected content without written permission.

13. Product Photos and Colors

We make reasonable efforts to accurately display product photographs, finishes, and colors. However, colors may appear differently depending on lighting, photography, display settings, and materials.

Minor variations in finish, texture, weld appearance, coloration, or other characteristics may occur as a result of the handcrafted manufacturing process and do not necessarily constitute a defect.

14. Website Information

We attempt to keep website information accurate and current. However, typographical errors, inaccuracies, omissions, or outdated information may occasionally occur.

We reserve the right to correct errors and update product information, pricing, availability, specifications, and other website content at any time.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Golden Goose Smokers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase or use of our products.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

16. Compliance With Applicable Laws

Customers are responsible for using our products in compliance with all applicable federal, state, and local laws, regulations, fire codes, building codes, zoning requirements, and safety requirements.

17. Governing Law

These Terms will be governed by the laws of the State of Vermont, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this website with a revised effective date.
